What is a Violation?
A violation is any action taken by a licensee or certificant of this board that is contrary to the ND Chiropractic Law or Administrative Rules.
Board's Authority
The Board is authorized by law to take disciplinary action against a license or certificant, if the licensee or certificant has violated the Law and/or the Administrative Rules. The law establishing the Board was enacted by the legislature as a means of protecting the safety and welfare of the public.
N.D.C.C. 43-06-15 lists the grounds for revocation or suspension of a chiropractic license or other action of the Board.
N.D.C.C.43-06-16.1(8) list the grounds for revocation or suspension of a certified chiropractic clinical assistant or other action of the Board.
Is it a Violation?
The Board and its legal counsel may not offer legal advice to the public or licensees. We may answer general questions, but may only be able to advise you to seek private legal counsel for advice on whether or not to report a potential violation.
Unlicensed Practice of Chiropractic
Persons practicing chiropractic without a valid North Dakota license are breaking the law. The Board has no jurisdiction over these individuals as they do not hold a license under the Board. Such persons should be reported to the Board and the County State’s Attorney for possible investigation and prosecution.
Uncertified Chiropractic Assistant
Individuals performing the duties of a certified chiropractic clinic assistant without a ND certification are breaking the law. The Board has no jurisdiction over these individuals as they do not hold a certification under the Board. Such persons should be reported to the Board and the County's State's Attorney for possible investigation and prosecution.
