Executive Session Recordings

At the January 21, 2022 board meeting the ND Board of Chiropractic Examiners issued the following statement:

“An announcement was made that because the Board has not received any guidance from the Attorney General’s Office regarding whether N.D.C.C. 43-06-14.1(7) is applicable to all information received by the Board in relation to disciplinary cases, the Board would be discussing all disciplinary cases in executive session.  Should the Attorney General’s Office determine that N.D.C.C. 43-06-14.1(7) does not apply, the Board will unilaterally make all portions of the executive session recording, which are not subject to other exceptions under the law, open and accessible to the public.”

On January 9, 2024, the Office of Attorney General issued the open record opinion 2024-O-03.

At the Board meeting held on January 19, 2024, the Board voted to release the executive session recordings held between January 21, 2022 and January 19, 2024 when the legal authority for the executive session included N.D.C.C. 43-06-14.1(7), pursuant to N.D.A.G. 2024-O-03.

The Board further voted to waive its right to redact these recordings pursuant to other legal authorities for the executive sessions, and will only redact identifiable personal health information (PHI). PHI is confidential pursuant to HIPAA, 45 C.F.R. 160.103. When redactions are required, the sound will be muted on the audio recordings. Additionally on any video recordings, the video will be blurred along with muting the sound.

The recordings will be released in chronological order – from oldest to newest – as each recording is completed.

These recordings will be publicly available for thirty (30) days. The thirty days will commence with the posting of the final recording. The final recording was posted on February 16, 2024; they will be available on this website until March 18, 2024. After this time, they will no longer be publicly available on this website and retained or purged per the ND Record Retention laws.
